Abstract

This paper deals with wars of national liberation in the context of occupation. The law of occupation in international humanitarian law has developed to include wars of national liberation. Hence this study identify the interrelated link between the developments of the fundamental right to self-determination and international humanitarian law and looks at the rights and obligations of members of national liberation movements when engaged in armed struggle against an occupying state. It is observed that while Humanitarian law provides clear guidelines for the occupying powers, it fails provide the same with respect to members of National Liberation Movements.
