Abstract

Ανάλυση της έννοιας της διεθνούς διαφοράς, όπως αυτή γίνεται αντιληπτή στο πλαίσιο του Δημόσιου Διεθνούς Δικαίου , μέσα από το πρίσμα της πρόσφατης νομολογίας Διεθνών Δικαστηρίων. Κατά την ανάλυση γίνεται αναφορά τόσο σε υποθέσεις του παρελθόντος που έχουν συντελέσει στην οριοθέτηση της έννοιας της διεθνούς διαφοράς καθώς και σε δύο από τις πιο πρόσφατες υποθέσεις που έχουν αγγίξει το παραπάνω ζήτημα. Πιο συγκεκριμένα εξετάζονται δύο πρόσφατες υποθέσεις . Η πρώτη είναι υπόθεση του Διεθνούς Δικαστηρίου που αφορά στις Υποχρεώσεις σχετικά με τις διαπραγματεύσεις σχετικά με την παύση της κούρσας πυρηνικών όπλων και τον πυρηνικό αφοπλισμό - Νήσοι Μάρσαλ κατά Ηνωμένου Βασιλείου - 2016) και η άλλη είναι υπόθεση που αρμοδιότητας του Διεθνούς Δικαστηρίου για το Δίκαιο της Θάλασσας (Διαφωνία σχετικά με την οριοθέτηση των Θαλάσσιων Συνόρων μεταξύ Μαυρικίου και Μαλδιβών στον Ινδικό Ωκεανό-Μαυρίκιος εναντίον Μαλδιβών- Προκαταρκτικές Ενστάσεις-2021). Analysis of the concept of international dispute, as it is perceived in the context of International Law, through the prism of the recent case law of International Courts. The analysis refers both to cases of the past that have contributed to the demarcation of the concept of international difference as well as to two of the most recent cases that have touched upon the issue. More specifically, two recent cases are being examined. The first is a case from the International Court of Justice concerning the Obligations concerning Negotiations relating to Cessation of the Nuclear Arms Race and to Nuclear Disarmament -Marshall Islands v United Kingdom -Preliminary Objections-2016 and the other one is a case under the jurisdiction of the International Tribunal for the Law of the Sea (Dispute Concerning Delimitation of the Maritime Boundary between Mauritius and Maldives in the Indian Ocean-Mauritius v. Maldives- Preliminary Objections-2021).
