Αν και η απεργία πείνας αποτελεί ιστορικά μια συνήθη μορφή διαμαρτυρίας, η θεωρητική προσέγγιση εστιάζει κυρίως στις ιατρικές και ηθικές πτυχές της. Όσον αφορά τα ανθρώπινα δικαιώματα, υπάρχει αυξανόμενη νομολογία από διεθνή και ευρωπαϊκά δικαστήρια, καθώς και εκθέσεις από διεθνείς και ευρωπαϊκές επιτροπές, που αναλύουν τη σύγκρουση των δικαιωμάτων των κρατουμένων και των υποχρεώσεων του κράτους· διερευνούν τη νομιμότητα της αναγκαστικής σίτισης και τα όριά της, σε σχέση με την ανθρώπινη αξιοπρέπεια και το σεβασμό της προσωπικής αυτονομίας. Η παρούσα εργασία επιχειρεί να εξετάσει το ανωτέρω δίλημμα μεταξύ των δικαιωμάτων του απεργού πείνας και των υποχρεώσεων του κράτους, υπόψιν της σχετικής διεθνούς νομολογίας, και να προτείνει μια κατάλληλη απάντηση σε μια απεργία πείνας. Although hunger striking is a common form of protest through history, literature mainly focuses on medical and ethical aspects of the topic. Regarding the human rights aspect, there is growing case law from international and European courts, as well as reports and comments from international and European committees, that delve into the conflict of the rights of the prisoners and the responsibilities of the State; they explore the legitimacy of force-feeding and its boundaries regarding human dignity and the respect of personal autonomy. This paper attempts to examine this dilemma between the rights of the hunger striker and the obligations of the State, in view of the relevant international case law, and offers a conclusion for the appropriate response to a hunger strike.
